India's top court dismisses gov't objections on leaked Rafale docs

India's Supreme Court Wednesday dismissed preliminary objections raised by the federal government over certain classified documents which had raised several questions over the multi-million-dollar Rafale aircraft deal and said it will examine them, officials said.

The top court said it would hear the review petitions in the light of new documents cited by petitioners.

A three-judge bench, headed by Chief Justice of India Ranjan Gogoi, decided by unanimity that the new documents will be relied upon by the top court.

The federal government through the attorney general had submitted that the privilege documents were procured by petitioners in an illegal way.

The apex court said it will fix a date for hearing the review petitions.

"The judgment goes completely against the arguments that were put forward by the government through its attorney general -- these are the secret documents and they have been stolen and we had argued the contrary," said Arun Shourie, a petitioner in the case.

In last December, the top court dismissed petitions alleging federal government had gone for an overpriced deal for 36 Rafale fighter jets. Following the dismissal, the petitioners filed a review petition.

India in 2016 signed a deal with France for the purchase of 36 Rafale fighter jets in a bid to bolster the country's military image.

Congress and other opposition parties alleged India's main ruling Bharatiya Janata Party has indulged in a gross corruption while finalizing the deal and demanding a joint parliamentary committee probe into the matter.
