Video website ordered to pay CCTV US$40,000 compensation

The operators of video sharing website tudou.com have been ordered to pay 248,000 yuan (US$39,800) compensation to China Central Television International Network Co for copyright infringement.

The decision was made at a district court in Shanghai, which ruled that the website had broadcast episodes of the network's popular food and culture show, "A Bite of China," without authorization, the Shanghai Intellectual Property Administration said yesterday.

The network claimed compensation from Shanghai Quan Toodou Cultural Communication Co, operators of tudou.com, for its losses, and expenses relating to investigation and evidence collection, it said.

"A Bite of China" first appeared in 2012 and was well received both at home and abroad. A second season began airing on CCTV on Friday.

The court said the network held both the copyright to the program and the rights to broadcast it online.

The defendant argued that the videos had been uploaded to its servers by its users, but was unable to provide supporting evidence as it had earlier deleted them.

The court ruled that tudou.com had caused huge economic losses and was ordered to pay 240,000 yuan compensation and 8,000 yuan costs.

The suit was one of 10 example cases reported yesterday by the administration.

Last year, courts in Shanghai heard 6,656 intellectual property cases, up 25 percent on 2012, the administration said. In the same period, Shanghai police handled 2,589 cases of IPR infringement cases and counterfeiting, up 77 percent.
