UN expert calls for more actions to support Palestinian struggle

A United Nations Special Rapporteur on Monday called the Human Rights Council (HRC) and the International Court of Justice to put more effort to help the Palestinian people due to Israel's non-compliance with human rights and international legal obligations.

"The credibility of the Human Rights Council is very much at stake if there is nothing that's done about either non-cooperation or non-compliance," Richard Falk, Special Rapporteur on the situation of human rights in the occupied Palestinian territories told reporters after briefing the ongoing 20th session of the HRC.

Falk said that Israel continued to refuse to cooperate with the mandate and expressed concern about Israel's frequent use of administrative detention, and the expansion of Israeli settlements and related violence by Israeli settlers against Palestinians in the West Bank, including East Jerusalem.

Falk recommended the HRC in his report to adopt a resolution and to mandate a special body to prepare a study on Israel's use of administrative detention.

He also suggested that the International Court of Justice should be requested to provide an Advisory Opinion on the Israeli practice of transferring detained Palestinians to prisons in Israel.

He said that the Israeli settlement expansion has accelerated, which reinforces the sense that "the 'peace process' is a trick rather than a way of achieving the solution to the conflict."

Falk said as Israel has demonstrated that it is non-responsive to resolutions or to near unanimous decision of the International Court of Justice, the importance of resolutions or even the advisory opinions from the International Court of Justice is not to change the behavior of Israel.

"The resolutions and any kind of action by the International Court of Justice or other international judicial bodies is very important in establishing the legitimacy of Palestinian grievances and in creating a sense of the appropriateness of taking action, like the BDS campaign proposes," he said.
