India's Supreme Court on Wednesday allowed an Italian ship to leave the country's waters, more than two months after it was detained as two marines on board allegedly killed two Indian fishermen off the coast of the southern state of Kerala, sources said.

However, the Italian marines, currently facing murder charges for allegedly shooting dead the two fishermen, will not be released.

The apex court also allowed six crew members and four other marines on board the Enrica Lexie to leave India, the sources said.

The Supreme Court, however, released the ship and the crew on the condition that its owner will guarantee that its crew members be produced if their testimonies are needed by the police and the court.

The incident happened in February when two marines on board the ship allegedly shot dead the two Indian fishermen mistaking them to be pirates.

It sparked a diplomatic row with Italy which claims New Delhi has no jurisdiction over the case as the incident happened on international waters.

Italy last week agreed to pay 10 million rupees (190,000 U.S. dollars) to each of the dead fishermen's families.
