Indian president's election challenged in Supreme Court

India's former Parliament Speaker and opposition Bharatiya Janata Party (BJP)-backed presidential candidate P.A. Sangma Tuesday moved the country's Supreme Court, challenging Pranab Mukherjee's election as the Indian President.

In his petition, Sangma has claimed that 77-year-old Mukherjee was holding an office of profit -- the Chairman of Indian Statistical Institute -- at the time of his nomination and proper procedure was not followed in the acceptance of Mukherjee's resignation from the institute.

Mukheree, supported by the country's ruling Congress-led United Progressive Alliance, defeated Sangma by a huge margin in the presidential poll last month, bagging nearly 70 percent of the total votes cast by the electorate comprising Members of Parliament and state legislators.

This is the second time in the history of India that a president's election has been challenged.

In 1969, then President V.V. Giri's election was challenged, citing use of malpractices to woo votes. However, the Supreme Court had then dismissed the petition and his election was upheld. He had defeated then Congress nominee Neelam Sanjeeva Reddy.
